Affiliate Policy
Equlise LLC, a company incorporated under the laws of the State of Delaware, United States of America (hereinafter referred to as "we," "us," "our," or "Equlise"), operates Swittch, a rewards platform accessible via web browsers, Android, and iOS applications (collectively, the "Service"). This Affiliate Policy governs the terms under which individuals or entities (hereinafter referred to as "Affiliates," "you," or "your") may participate in the Swittch Affiliate Program (the "Program") to promote the Service and earn rewards through referrals. By participating in the Program, you agree to be bound by this Affiliate Policy, which forms an integral part of our Terms and Conditions.
1. Eligibility for the Affiliate Program
To participate in the Program, you must be a registered user of the program, accessible through the website ‘affiliates.swittch.app’, be at least 18 years of age, and in compliance with all applicable laws and regulations in your jurisdiction. We reserve the right to approve or reject your participation in the Program at our sole discretion, based on factors such as your compliance history, promotional methods, or suitability for the Program. Participation in the Program does not constitute an employment relationship with Equlise LLC, and Affiliates are considered independent contractors responsible for their own taxes, legal compliance, and expenses.
2. How the Affiliate Program Works
Upon acceptance into the Program, you will be able to generate ith a unique referral links on Swittch Affiliate Portal (the "Affiliate Link") that identifies you as the referrer. You may share your Affiliate Link through approved channels, such as social media, email, blogs, or personal websites, to encourage new users to register for the Service. When a new user registers using your Affiliate Link and completes qualifying actions called ‘goals’, such as signing up and earning a minimum number of points through surveys, you will earn rewards. Rewards include a one-time bonus for each successful referral and lifetime rewards based on the referred user’s activity, as determined by us and subject to the terms herein.
3. Affiliate Rewards and Payouts
Rewards earned through the Program are awarded in the form of on-screen metrics, which may be redeemed for cash via PayPal, gift cards from providers such as Amazon, Spotify, Starbucks, Apple, or other options as determined by us. A successful referral is defined as a new user who registers using your Affiliate Link, verifies their account, and completes qualifying actions within a specified timeframe, typically 30 days from registration. Lifetime rewards are calculated as a percentage of the referred user’s earnings, subject to a cap and duration as specified by us at our discretion. We reserve the right to adjust reward structures, set minimum payout thresholds, and withhold rewards if we determine that referrals were generated through fraudulent or prohibited means. Payouts are processed in accordance with the Service’s standard redemption processes, and you are responsible for ensuring that your payment information is accurate and up to date.
4. Prohibited Activities
You agree to promote the Service in a lawful, ethical, and professional manner. You shall not engage in any activities that violate these Terms, including but not limited to using automated systems, bots, or scripts to generate referrals, misrepresenting the Service or its features, or engaging in spamming, phishing, or other deceptive practices to distribute your Affiliate Link. You are prohibited from sharing your Affiliate Link on websites or platforms that contain illegal, offensive, or inappropriate content, or that promote activities contrary to the values of Swittch, such as gambling or adult content. Additionally, you shall not bid on or use Swittch-related keywords in paid advertising campaigns, create duplicate accounts to earn rewards, or incentivize referrals through unauthorized means, such as offering payments or rewards outside the Program. Violation of these terms may result in the immediate termination of your participation in the Program, forfeiture of earned rewards, and potential legal action.
5. Intellectual Property and Promotional Materials
We grant you a limited, non-exclusive, non-transferable, revocable license to use Swittch trademarks, logos, and promotional materials provided by us solely for the purpose of promoting the Service in accordance with this Policy. You shall not modify, alter, or create derivative works of such materials without our prior written consent. All promotional content must accurately represent the Service, including its commitment to zero fees, zero bots, and zero ads, and must not make false or misleading claims about earnings or rewards. You are responsible for ensuring that your promotional activities comply with all applicable laws, including advertising and consumer protection regulations. We reserve the right to review and request the removal of any promotional content at our discretion.
6. Termination of Affiliate Participation
We reserve the right to terminate your participation in the Program at our sole discretion, with or without notice, for any reason, including but not limited to your violation of this Policy, fraudulent activity, or conduct that we deem harmful to the Service or other users. Upon termination, your right to earn rewards through the Program will cease immediately, and any unredeemed rewards in your account may be forfeited without compensation. You may also terminate your participation in the Program at any time by notifying us at hello@swittch.com, after which you must cease using your Affiliate Link and any Swittch promotional materials.
7. Disclaimers and Limitation of Liability
The Program is provided on an "as is" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Program will be uninterrupted, error-free, or that you will earn any specific amount of rewards. To the fullest extent permitted by law, Equlise LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your participation in the Program, including loss of profits or data. Our aggregate liability to you for any claim arising under this Policy shall not exceed the total amount of rewards you have redeemed through the Program in the six months preceding the claim.
8. Governing Law and Dispute Resolution
This Affiliate Policy shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to this Policy or your participation in the Program shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you hereby consent to the jurisdiction of such courts. You waive any objection to venue in such courts and any claim that such forum is inconvenient.
9. Changes to This Affiliate Policy
We reserve the right to modify this Affiliate Policy at our sole discretion to reflect changes in our practices, legal requirements, or Program features. Any modifications will be posted on this page with a revised "Last Updated" date. Where required by law, we will notify you of material changes through email, in-app notifications, or other reasonable means prior to the effective date of such changes. Your continued participation in the Program following the posting of an updated Policy constitutes your acceptance of the revised terms.
